These Terms of Service ("Terms") constitute a legally binding agreement between you and THE MIND GAUGE LTD (trading as Nomadoverse). By accessing or using nomadoverse.com or purchasing our products, you agree to be bound by these Terms.
Acceptance of Terms
By accessing our website at nomadoverse.com, creating an account, or making a purchase, you confirm that you:
- Have read, understood, and agree to these Terms of Service
- Have read and agree to our Privacy Policy
- Are at least 18 years of age (or the legal age of majority in your jurisdiction)
- Have the legal capacity to enter into a binding contract
If you do not agree to these Terms, you must not use our website or services.
About Nomadoverse
Nomadoverse is a trading name of THE MIND GAUGE LTD, a company registered in England and Wales. We operate an online platform for the sale of digital eSIM (embedded SIM) products, providing international mobile data connectivity to travellers and global users.
Eligibility
Our services are available to individuals aged 18 or older worldwide, except where restricted by applicable law. By using our services, you represent and warrant that:
- You are at least 18 years of age
- You are not located in a country subject to a UK government, EU, or UN embargo
- You are not listed on any government prohibited or restricted party list
- Your use of our services complies with all applicable laws in your jurisdiction
- You will not use our services for any unlawful purpose
eSIM Products — Description & Limitations
What is an eSIM?
An eSIM (embedded SIM) is a digital SIM profile that is downloaded directly to your compatible device. Our eSIM products provide mobile data connectivity in supported countries and regions.
Device Compatibility
eSIMs require a compatible device. You are solely responsible for verifying that your device supports eSIM technology before purchasing. We provide compatibility guidance on our product pages, but we cannot guarantee compatibility with every device or carrier configuration. No refund will be issued if your device is not eSIM compatible.
Coverage & Network Quality
Mobile data coverage depends on local network infrastructure in the destination country. We do not guarantee:
- Uninterrupted or error-free service
- Specific data speeds or network generation (4G/5G availability)
- Coverage in remote, rural, or underground areas
- Service during network outages or maintenance by local carriers
Data Allowance
eSIM plans are sold with a defined data allowance and/or validity period as specified at time of purchase. Data not used within the validity period is forfeited with no refund.
Fair Use Policy
Our eSIM products are for personal use only. Commercial resale, tethering for large-scale commercial operations, or any use that disproportionately consumes network resources may result in speed throttling or account suspension by the underlying network operator.
Orders & Payment
Placing an Order
By placing an order on nomadoverse.com, you are making a binding offer to purchase the selected eSIM product. The contract is formed when we send you an order confirmation email.
Pricing
All prices are displayed in USD (or as selected) and are inclusive of applicable taxes where stated. We reserve the right to change prices at any time without notice. The price at time of checkout is the price you pay.
Payment Processing
Payments are processed securely by Stripe, Inc., a third-party payment processor. We accept major credit and debit cards (Visa, Mastercard, American Express) and other payment methods as displayed at checkout. By providing payment details, you authorise us to charge the full order amount.
⚠️ We do not store your payment card details. All payment data is handled directly by Stripe under PCI-DSS Level 1 standards. For Stripe's terms, visit stripe.com/legal.
Order Cancellation
Orders for digital eSIM products cannot be cancelled once the eSIM profile has been issued or activated. Please review our Refund Policy for full details.
Currency & Taxes
You are responsible for any import duties, taxes, or levies applicable in your jurisdiction. We collect VAT/GST where legally required. Prices displayed may or may not include applicable taxes depending on your location.
Delivery of Digital Products
Upon successful payment, your eSIM profile and installation instructions will be delivered to your registered email address. Delivery is typically instant or within minutes of purchase confirmation.
We are not responsible for delivery failures caused by:
- Incorrect email address provided at checkout
- Emails blocked or filtered as spam by your email provider
- Temporary technical issues beyond our control
If you have not received your eSIM within 30 minutes of purchase, please check your spam/junk folder and contact us at [email protected].
Acceptable Use Policy
You agree to use our services only for lawful purposes. You must NOT use our services to:
- Violate any applicable local, national, or international law or regulation
- Resell, redistribute, or sublicence eSIM products without our written consent
- Engage in any fraudulent, deceptive, or misleading activity
- Transmit any unsolicited commercial communications (spam)
- Attempt to gain unauthorised access to our systems or networks
- Introduce malware, viruses, or other malicious code
- Scrape, crawl, or harvest data from our website without permission
- Use our services in any way that could damage our reputation or business
- Engage in any activity that violates the terms of the underlying network operators
Violation of this Acceptable Use Policy may result in immediate suspension of your account and any active eSIM services without refund.
Intellectual Property
All content on nomadoverse.com — including text, graphics, logos, icons, images, product descriptions, and software — is the property of THE MIND GAUGE LTD or its content suppliers and is protected by UK and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use our website for personal, non-commercial purposes only. You may not:
- Copy, reproduce, or distribute any content without written permission
- Modify or create derivative works of our content
- Use our trademarks, logos, or brand elements without authorisation
- Remove any copyright or proprietary notices
Disclaimers & Warranties
To the maximum extent permitted by applicable law, our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Implied warranties of merchantability or fitness for a particular purpose
- Warranties that the service will be uninterrupted, timely, secure, or error-free
- Warranties regarding the accuracy or completeness of any information
- Warranties that defects will be corrected
Nothing in these Terms affects your statutory rights under applicable consumer protection law. EU and UK consumers retain non-waivable statutory rights under the Consumer Rights Directive and Consumer Rights Act 2015 respectively.
Limitation of Liability
To the fullest extent permitted by applicable law, THE MIND GAUGE LTD and Nomadoverse shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business, or goodwill
- Loss of connectivity, missed communications, or travel disruptions caused by service unavailability
- Any damages arising from your reliance on information on our website
- Damages arising from third-party network failures, outages, or service degradation
- Unauthorised access to or alteration of your data
Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you for the specific order giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless THE MIND GAUGE LTD, its directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your violation of these Terms
- Your use of our services in violation of any applicable law
- Your infringement of any third-party intellectual property or other rights
- Any misrepresentation made by you
Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or for any other legitimate business reason.
Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimer, limitation of liability, indemnification, and governing law) shall survive.
Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
For EU consumers: Nothing in this clause deprives you of the protection afforded by mandatory provisions of the law of your country of residence. You may also bring proceedings in the courts of your country of habitual residence.
For UK consumers: You retain rights under the Consumer Rights Act 2015 and other applicable UK consumer protection legislation.
For US consumers: Additional rights may apply under your state's consumer protection laws. California residents retain rights under CCPA/CPRA.
Dispute Resolution
Informal Resolution
Before initiating any formal dispute proceedings, we encourage you to contact us at [email protected]. We will make good faith efforts to resolve your concern within 30 days.
EU Online Dispute Resolution
If you are an EU consumer and we are unable to resolve your complaint, you may use the European Commission's Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr
UK Alternative Dispute Resolution
UK consumers may refer unresolved disputes to an approved ADR scheme. Details available on request.
Formal Proceedings
If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, subject to the consumer rights exceptions noted in Section 13.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide reasonable notice of material changes by:
- Posting the updated Terms on our website with a new "Last updated" date
- Sending an email notification to registered customers (for material changes)
Continued use of our services after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using our services.
